Agreement to Terms
These Terms of Service ("Terms") govern your use of the John Claude Painting website located at johnclaudepainter.com ("Site") and any painting services provided by John Claude Painting ("Company," "we," "us," or "our"). By accessing our Site or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Site or use our services.
Services
Description of Services
John Claude Painting provides professional painting services including but not limited to interior painting, exterior painting, cabinet painting, commercial painting, and stucco repair services for residential and commercial properties in the Phoenix metropolitan area.
Service Estimates
We provide free estimates for painting projects. Estimates are based on information provided by the customer and a visual inspection of the property. Final pricing may be adjusted if conditions differ from those observed during the estimate or if the scope of work changes.
Service Agreements
All painting projects require a written service agreement or contract outlining the scope of work, pricing, timeline, and payment terms. Work will not commence until the agreement is signed and any required deposits are received.
Website Use
Intellectual Property
The Site and its original content, features, and functionality are owned by John Claude Painting and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Permitted Use
You may use our Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates any applicable law or regulation
- Use the Site to transmit any advertising or promotional material without our prior consent
- Attempt to gain unauthorized access to any portion of the Site or any systems connected to the Site

User Content
If you submit testimonials, reviews, photos, or other content to us, you grant John Claude Painting a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, publish, and display such content for marketing and promotional purposes.
Payment Terms
Deposits
A deposit may be required to schedule your painting project. The deposit amount will be specified in your service agreement. Deposits are applied to the final balance due.
Payment Schedule
Payment terms are specified in each service agreement. Typically, final payment is due upon satisfactory completion of the project. We accept cash, check, and major credit cards.
Late Payments
Payments not received within the specified terms may be subject to late fees as outlined in your service agreement. We reserve the right to suspend work on projects with outstanding balances.
Project Terms
Access and Preparation
Customers are responsible for providing adequate access to work areas. We request that work areas be cleared of personal items, furniture, and obstacles before our team arrives. We will protect remaining items with drop cloths and plastic sheeting.
Timeline
Project timelines provided are estimates only. Actual completion times may vary due to weather conditions, material availability, scope changes, or unforeseen circumstances. We will communicate any significant delays promptly.
Color Selection
Customers are responsible for final color selection. We recommend testing paint colors on small areas before full application. Slight color variations between samples and final application are normal and do not constitute grounds for rework at no charge.
Change Orders
Any changes to the original scope of work must be agreed upon in writing. Additional work will be billed according to our current labor and material rates or as negotiated.
Warranty
Workmanship Warranty
We stand behind our work and offer a workmanship warranty as specified in your service agreement. This warranty covers defects in our application and craftsmanship under normal use conditions.
Warranty Limitations
Our warranty does not cover:
- Damage caused by improper use, abuse, or neglect
- Damage from external factors such as weather, settling, or structural movement
- Normal wear and tear, fading, or chalking
- Damage caused by other contractors or trades
- Issues resulting from customer-supplied materials
- Pre-existing conditions not disclosed during the estimate
Manufacturer Warranties
Paint and material warranties are provided by the respective manufacturers. We can provide information on applicable manufacturer warranties upon request.
Limitation of Liability
To the maximum extent permitted by law, John Claude Painting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of our Site or services.
Our total liability for any claims arising from or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless John Claude Painting and its employees, contractors, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Site or violation of these Terms.
Dispute Resolution
Any disputes arising from these Terms or our services shall first be attempted to be resolved through good faith negotiation. If a resolution cannot be reached, disputes shall be settled through binding arbitration in Maricopa County, Arizona, in accordance with Arizona law.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will notify users of any changes by updating the "Last updated" date. Your continued use of the Site or services after any changes constitutes acceptance of the new Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
